BloodConnect Africa is a platform that facilitates connections between blood donors and recipients. This platform is NOT a substitute for professional medical advice, diagnosis, or treatment. Always consult qualified healthcare professionals for medical decisions. Blood donation eligibility is subject to medical screening by licensed healthcare providers.
1. Acceptance of Terms
By accessing or using BloodConnect Africa ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Platform.
These Terms constitute a legally binding agreement between you and BloodConnect Africa regarding your use of the Platform. We may modify these Terms at any time by posting the revised Terms on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms.
We will notify you of significant changes via email or platform notification at least 30 days before the changes take effect.
2. Eligibility
To use this Platform, you must:
- Be at least 18 years old (or meet the minimum blood donation age in your jurisdiction, typically 16-18 years with parental consent)
- Provide accurate and truthful information in your profile and health screening forms
- Have legal capacity to enter into this agreement
- Not be prohibited from using the Platform under applicable laws
If you are registering on behalf of an organization (blood bank, hospital, etc.), you represent that you have authority to bind that organization to these Terms.
3. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate health information for donor screening
- Updating your information when it changes
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Our Services
BloodConnect Africa provides:
- A platform to connect blood donors with recipients in need
- AI-powered donor-recipient matching based on blood type compatibility
- Donor eligibility screening based on WHO guidelines
- Emergency blood request notifications
- Donation scheduling and appointment management
- Communication tools between donors, recipients, and blood banks
4.1 Service Limitations
- We do not perform blood collection, testing, or transfusion
- We do not provide medical advice or diagnoses
- We do not guarantee blood availability or donor response
- All donations must be conducted at licensed facilities
5. User Conduct
You agree NOT to:
- Provide false information about your identity, health status, or donation eligibility
- Misuse emergency features for non-emergency purposes
- Harass, threaten, or abuse other users
- Attempt to sell blood or blood products through the Platform
- Use automated systems to access the Platform without permission
- Interfere with the Platform's operation or security
- Violate any applicable laws or regulations
- Use the Platform for commercial purposes without authorization
Violation of these rules may result in immediate account termination and may be reported to relevant authorities.
6. Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We are not liable for:
- Medical outcomes resulting from donations facilitated through the Platform
- Delays or unavailability of blood products
- Actions of third parties, including blood banks, hospitals, or other users
- Service interruptions or data loss
- Inaccuracies in AI-generated recommendations
- Decisions made based on information from the Platform
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.
7. Indemnification
You agree to indemnify and hold harmless BloodConnect Africa, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of another party.
8. Intellectual Property
All content, features, and functionality of the Platform (including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof) are owned by BloodConnect Africa or its licensors and are protected by international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Platform without our prior written consent.
9. Termination
We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including:
- Breach of these Terms
- Fraudulent or illegal activity
- Providing false health information
- Misuse of emergency features
- At our sole discretion
Upon termination, your right to use the Platform will immediately cease. You may request deletion of your data in accordance with our Privacy Policy.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BloodConnect Africa is registered, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
